There are so many Clauses they are going to catch them out with, and not just in the HRT. Admittedly, maybe lots of Eastern Euro's may come and try, not knowing any better, like some others i know :rolleyes: .......but i can assure you, what you Posted, and what's the truth, are far removed, and the Eastern Euro's will get a big shock if they believe the same as you seem to do!

The subject is not about Asylum seekers, it is about getting a Settlement Visa. Asylum seekers are only a small % of immigrants and are not all named Mahomed. and most are from Africa.

Council Tax and Housing Benefit for Refugees and Asylum Seekers

You are eligible for benefit if you have been granted 'leave of stay' on a permanent or temporary basis. You will need to provide evidence of this such as paperwork from the Home Office or the details stamped in your passport.
Council Tax Liability

A dwelling provided to an asylum seeker under, or under arrangements made under, Section 95 of the Immigration and Asylum Act 1999 will be owner liability class F.

This will mean that the owner and not the residents, will be liable to pay the Council Tax Charge.

For further information please visit the Council tax webpage
Council Tax Benefit

As you will not be liable for Council Tax there will be no need for you to claim Council Tax Benefit.

However if you have refused accommodation from the National Asylum Seekers Service (NASS) and have chosen to stay with people who are currently in receipt of Housing or Council Tax Benefit, this will cause a non-dependant deduction for the people you are residing with. More rubbish, a friend of mine is having similar probs with his wife who is from Kenya, the law applies to ALL spouses going for a settlement visa, not just Thais.

On one hand you say the law is too relaxed, then on the other, you say it is too tight. The UK have tightened up immigration laws full stop. Be glad of it or not, but it is not specific to Thais.

This is what I don't understand. I pay around £15k in taxes annually. My wifes doesn't work and doesn't get benefits. So she is NOT taking away employment from a national and she is not getting any money. SO WHAT THE FUCK IS THEIR PROBLEM? There are cunts coming here getting houses and money thrown at them. It is these cunts they want to hit not nationals who WILL just fuck off and take their income elsewhere on this planet. Again, as I have said. They have not thought this through. Mindless idiots.

Mr. P, what course was it your wife did? I would doubt it would still be vailid but I tried getting in touch with the wankers that drumoak left a link to and they have failed to reply to my email of 5 days ago.

A legal attempt to deport a failed asylum seeker who killed a 12-year-old girl in a hit-and-run crash has failed.

Aso Mohammed Ibrahim, an Iraqi Kurd who was already banned from driving, left Amy Houston dying under the wheels of his car in Blackburn. He was jailed for four months over the girl's death, in 2003, but allowed to remain in the UK on his release.

The UK Border Agency (UKBA) appealed against the decision, backed by Amy's father Paul, but that was rejected by two senior immigration judges last year. Mr Houston has been campaigning for years to get Ibrahim deported.

He was allowed to stay in the UK because He Married a British Woman.

well you lot have been busy while i was out
ok here is the full sp thus far
kate and i are in the unfortunate position of making an application right at the point of transition for a total shake up of immigration rules and personally i think it is the governments only way of covert racism [should have done it 20 yrs ago] but hey ho. they cannot openly discriminate but these new rules will stop a lot of dross coming in through this door. hopefully i have resolved my own dilemma and if anybody needs to follow suit then you only have a small window.
right the craic is that kate came here on a fiance/settlement visa which involves a 6 month fiance visa and providing you marry within that time you can apply for an extension settlement visa for 2 yrs. now, the problem arises that before, you just applied for the 2 yr job and took an english A1 level test after that for your next stage but what they have done is now said that you have to take the test now at the application stage of the 2 yr settlement visa. this has created major problems with the time line as they only test twice a month and they are full of applicants.
i managed to find a last place at wimbledon college for the IELTS test which is the new regs test. upon downloading the sample tests it is horrendous and is a 4 hour exam which i defy most on this board to pass.
so booked a place and thought shit or bust she has to take it. and no mistake or leniency if she fails she has to leave the country on may 12th when her visa expires. so i shell out £135 and book the place which means leaving leicester at 5.30am on sat. to arrive at the college and then wait 14 days for the results.
in the meantime drumoak [BIG SHOUT MATE I OWE YOU BEERS] suggests i contact the company who sorted for him, after several phone calls i manage to sort out that the old test, which takes approx 30-40 mins is still valid for 2 yr settlement applications up to july 13th i think and will be accepted. so the girl booked kate in for next wed for the test and we will either leave with the certificate or it will arrive by post 2-3 days later. cost £200
the company is EMD and there phone number is 0845 5332 786 they are most helpful and there is a guy there called jim who is up to speed on all the current regs and most helpful. i ring wimbledon to cancel the test on sat. but no refund so it has cost a pretty penny but cheaper than return flights and all the bollox of taking the test over there. EMD are also putting things in place for the new testing but that will be available after july.
anyone needing to do something now get on the phone and you should get a result.
meanwhile i wait for wed and will let you know how we go.

I'm sure you have already looked at the Example Tests on their website and will prepare prepare Kate for her test.

Should she fail, which hopefully she won't, she will not need to leave the country.
